Overtime Regulation Changes On Hold (December 2016)
As you may have heard, last week a Federal judge granted an injunction that delays the December 1st change to overtime rules. While stalled (or maybe at some point repealed), we caution anyone from thinking it’s a free pass. The spirit of the legislation was to automatically bring positions (mostly administrative) that are often misclassified as exempt from overtime pay into non-exempt status by increasing the salary threshold for exemption eligibility.
We recommend that you maintain any reclassifications you have already completed (unless you are VERY certain the role will pass the job duties test). Now that there is a heightened attention and awareness about the regulations, we advise you to manage communication with employees and next steps carefully.
